Terms of Service

1. The service

Daybreak connects to your Gmail with read-only access and produces a short daily summary of newsletter emails (messages with a List-Unsubscribe header) from the previous 24 hours. Summaries are generated by a third-party AI model and delivered in the app and (optionally) by email.

2. Billing

Paid subscriptions are processed by Polar, the merchant of record. Subscriptions renew automatically until you cancel. Charter pricing is offered to the first 100 paying subscribers and locked in for the lifetime of an uninterrupted subscription; if a Charter subscription lapses, re-subscription is at the standard price.

3. Right to cancel

If you are a consumer with rights under EU or other applicable consumer-protection law, you may cancel within 14 days of first purchase and receive a full refund. Email support@readdaybreak.com or cancel in-app. Outside the 14-day window, cancellation takes effect at the end of the current paid period.

4. Acceptable use

Use the service only on Gmail mailboxes you own or are authorised to access. Don't break the law, abuse the AI model, or attempt to extract content outside the newsletter scope. We may suspend accounts that violate these rules.

5. AI summaries — important

Summaries are generated by AI and may contain factual errors, hallucinated details, mis-attributed quotes, or important omissions. They are for informational convenience only. Do not rely on summaries for decisions involving health, legal, financial, professional, safety, or other consequential matters. For anything that matters, read the original newsletter and consult a qualified professional. We accept no liability for actions taken or not taken based on summary content.

6. Limitation of liability

Nothing here limits our liability for fraud, death or personal injury caused by our negligence, or anything else that cannot be excluded by law (including your statutory consumer rights). Otherwise, to the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is capped at six months of fees paid.

7. Termination

You can close your account anytime from Settings. We may suspend or terminate accounts that violate these Terms.

8. Changes

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect.

9. Governing law

These Terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction, except that consumers retain any mandatory protections of their country of residence.
